Terms of Service

CareCircle is a family health coordination tool that enables users to store, share, and organise health records for family members in their care. It is operated by CareCircle, registered in the Netherlands (KVK: 42045625).

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will give at least 30 days' notice before discontinuing the service entirely.

You must be at least 18 years old to create an account. You are responsible for:

• Keeping your login credentials secure and not sharing them with others.
• All activity that occurs under your account.
• Ensuring the accuracy of information you enter and documents you upload.
• Obtaining appropriate consent from care recipients before uploading their health records.

You may close your account at any time from Settings → Delete account. Closing your account permanently deletes your data and any circles you solely own.

A circle is a shared space for coordinating care for a care recipient. The person who creates a circle is its administrator and is responsible for managing member access.

Administrators may invite others to join a circle. By inviting someone, you confirm you have their consent to share the health information they will have access to.

You must not invite anyone to a circle without obtaining their prior agreement.

You own the data you upload. By uploading health records, you grant CareCircle a limited licence to store, process, and display that data for the purpose of providing the service to you and the members of your circle.

You are responsible for the accuracy of health records you upload. CareCircle does not verify the accuracy of any uploaded documents.

Health records are processed in accordance with our Privacy Policy.

The AI interpretation feature is optional and opt-in per document. When you trigger it:

• The document content is sent to a third-party AI provider (Anthropic) for processing.
• The result is an informational summary only (see Section 2).
• AI interpretations count against your plan's monthly quota and cannot be refunded if the result is unsatisfactory.

CareCircle offers a free tier and paid subscription plans (Premium and Family) billed monthly or yearly. Prices are displayed at checkout and on our pricing page.

• Subscriptions renew automatically until cancelled.
• You may cancel at any time from Settings → Billing. Access continues until the end of the current billing period.
• We do not offer refunds for partial billing periods except where required by Dutch consumer law.
• We reserve the right to adjust pricing. We will give at least 30 days' notice of price increases via email.

Payments are processed by Stripe. By subscribing you also agree to Stripe's end-user terms.

You may not use CareCircle to:

• Upload documents you do not have the right to share.
• Process the data of others without a lawful basis.
• Attempt to access another user's data without authorisation.
• Reverse-engineer, copy, or distribute any part of the service.
• Use the service in any way that violates applicable law.

To the fullest extent permitted by Dutch law, CareCircle's liability to you for any claim arising out of or relating to these terms or the service is limited to the amount you paid to us in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential losses, including loss of data, loss of revenue, or harm arising from clinical decisions made based on information in the app.

Nothing in these terms excludes liability that cannot be excluded under mandatory Dutch consumer law.

We may suspend or terminate your account if you breach these terms, with notice where practicable. In serious cases (e.g., fraud, illegal activity) we may act immediately.

Upon termination, your right to access the service ends. Data deletion follows our retention schedule.

These terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved informally will be submitted to the competent court in Amsterdam.

EU residents may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
